  Fort Macleod Skating Club Policies

Refund Policy: 

All program registration fees include a non refundable mandatory Skate Canada insurance fee.

Refunds may be requested within 30 days of program start date. 

No Refunds will be given after 30 days of the program start date. 

If you register late, no refunds will be issued 30 days from your registration date. 

Helmet Policy: 

All CanSkate, TotSkate & Pre Junior Star Skate must wear CSA approved helmet at all times while on the ice. 

Liability waiver and release: 

It us understood and agreed, as a condition of participation in skating programs offered by the Fort Macleod Skating Club and Skate Canada, That neither the club nor Skate Canada shall be liable for any injury, loss or damage suffered by the above noted member while traveling to or from or while participating in skating practices, competitions or other activities, however caused. If is further agreed that neither the Club nor Skate Canada is responsible for any injury, loss or damage caused by the member while traveling to or from or while participating in said practices competitions or other activities. The member, or his/her parent/legal guardian who has signed this form, shall idemnify the Club and Skate Canada and hold them harmless from any claims, demands or actions arising from or in respect of such injury, loss or damage.

Publicity Waiver: 

I understand that the Fort Macleod Skating Club may use photographs of their members during activities for promotional purposes and social media. Unless advised otherwise, I accept that my child's photograph may be used for propmotional purposes. 

Skate Canada Privacy Code: 

By signing this form and registering my minor child with a club or skating school and allowing your minor child to be registered nationally with Skate Canada and submitting this form, you indicate your acceptance of all terms and conditions associated with the Skate Canada Privacy code and expressly provide your consent to the collection, use and disclosure of your minor child's confidential information to register your minor child with Skate Canada in any capacity including, without limitation, as a Skate Canada registrant, coach or in connetion with your affiliation with a skating club or skating school and to administer various services, such as Skate Canada programs, services & events, contact you to provide you with relevant offers regarding events and competitions, all as set forth in the privacy code. In addition, through the submission of form, you expressly consent to the sharing or exchange of your confidential information with Skate Canada affiliates, which includes your local skating club or skating school or provincial association or section, and with service providers.

MEMBERSHIP

By-law 1
Membership in the Club shall be open to all, irrespective o f sex, age, creed, o r colour.

By-law 2
All members shall uphold, observe and conform to the By-laws, Rules and Regulations of Skate Canada,
the By-laws o f the Club and such regulations as made by the Executive of the Club.

By-law 3
Members of the Club shall be registered with Skate Canada and pay such registration and other fees to
Skate Canada as set from time t o time by Skate Canada. (See Skate Canada By-Law 1201 (1) (c) (ix), Skate
Canada By-law 1202(1) (a), Rule 2101, Policies and Procedures.)

By-law 4
For a member of the Club t o be considered in good standing with the Club, that member must pay Club
fees a s stipulated b y the Club Executive in advance of the membership year in question. Members will
not b e permitted to take part in any Club activities i f these fees are not paid within 30 days of the date
set for payment. Members i n arrears shall b e considered as having terminated their club membership.

By-law 5
Fees, skating rules and skating hours o f the Club shall b e as the Executive decides from time t o time.
Club membership shall commence on the first day o f the Skate Canada membership year, September 1 ,
or the date that fees are paid (whichever is the latter)and terminate on the last day o f the Skate Canada
membership year, August 31.

By-law 6
The Club Executive shall develop a suspension o r expulsion policy that contains a provision for
suspending o r expelling of any member o f the Club from such membership on terms and conditions that
are deemed appropriate and necessary b y the Club Executive. This Policy shall b e approved b y the
Executive from time to time and shall be in writing and made available to all members in advance of its
implementation. This policy must include an appropriate hearing and appeal process, which includes
principles o f due process, an appropriate reinstatement application process and an appropriate
graduated series o f disciplinary measures. The Executive may, b y written notice, terminate membership
for acting contrary to the Rules and Regulations of Skate Canada or the Club. The Executive shall give to
the individual a written explanation for the termination on request. The individual, if he/she s o desires,
shall have the right of appeal t o the Executive and to a General Meeting of Members. (Skate Canada By-Law 1204)

By-law 7
The classes of membership, eligibility and privileges shall be as follows:
• Individual Membership: Non-Skating members who have paid the fees set b y the Club and are
Associate Members of Skate Canada. Individual members of the legal age of 18 shall be entitled
to one vote at each Annual General Meeting and Special Meeting of the Club.
• Active Membership: All eligible skaters who participate in a Club Skating Program and who
have paid fees as set by the Club and are Associate Members o f Skate Canada. All Active
Members o f the legal age o f 18 shall be entitled t o one vote a t each Annual General Meeting
and Special Meeting of the Club. (Underage Active Members have n o vote but may be
represented by Special Members) [Note that if rights and privileges differ between members of
different Skating programs, this differentiation must be clearly specified.]
• Special Membership: Parent or guardian o f legally underage Active Members who have paid
the fees set by the Club and are Associate Members o f Skate Canada
• Partial Membership: All eligible skaters who are an Associate Member or Restricted Member of
Skate Canada through another HOME club and have paid a reduced fee set by the Club.
• Honorary Membership: The Annual Meeting of members may elect any person an Honorary
Member o f the Club. A n Honorary Member shall b e exempt from club dues (but not Skate
Canada dues) and shall not vote at meetings of the club unless otherwise qualified. They may
have a voice at the meetings of the Club.
• Restricted Membership: a Restricted Member is an individual who is a paid employee (of the
Club, Section o r Association), a non-active coach, a performing professional skater, o r a
professional dance partner. A restricted member i n not permitted t o hold elected office, may
not vote a t meetings, i s not permitted to compete in competitions, and i s not permitted to
officiate at tests or competitions. [Skate Canada By-law 1201(1) (c) (xi), By-law 1202 (2) and Rule
2001]
• Active Member (Non-voting rights): An Active member (Non-voting rights) is a member who
meets the following criteria. This includes a class o f membership with restricted voting rights.

LIABILITY

By-law 8
The Club shall not be responsible for any damage, injury or loss of property t o any member, guest, or
visitor t o the Club regardless of the reason o r nature o f such damage, loss o r injury: Every member,
guest or visitor shall use the Club facilities a t his or hers own risk. The Club shall participate i n Skate
Canada Liability and Member Accident programs. [Skate Canada By-law 1201 (1) (c) (viii)]

By-law 9
The members of the Executive, members of the Chairs of Committees and the Club Delegate to Skate
Canada must be members i n good standing o f the Club, be registered as Associate Members of Skate Canada, be of legal age, and be eligible persons (with exception o f Coaching Representative) as defined
by Skate Canada Rules.

By-law 10
The general management o f the club shall be vested i n The Executive consisting of: immediate Past
President, President, Vice-president, Secretary, Treasurer, four Directors at large and a Coaching
Representative. [Skate Canada By-law 1201 (1) (c) (ii)] All o f the above, with the exception o f the Past
President and the Coaching Representative shall be elected for 2 year terms a t the Annual General
Meeting.

By-law 11
The Executive shall hold office until the close o f the meeting at which their successors have been duly
elected. Any member o f the Executive may be removed by the members b y a 2/3 majority vote a t a
Special General Meeting duly called for that purpose.

By-law 12
A quorum o f the Executive shall consist o f 50% plus 1 members o f the Executive, including the Chair.
NOTE: Questions arising a t any meeting o f the Executive shall b e decided by a majority o f votes. The
meeting chair may vote only when the vote would change the result. Therefore the chair may vote to
break a tie, and thus pass the motion, or t o create a tie, and thus defeat a motion. A majority o f the
Executive shall form a quorum. [Skate Canada Bylaw 1420 (5)]

By-law 13
Casual vacancy occurring between any Annual General Meeting of the Club, may b e filled, until the next
annual General Meeting by a majority vote of the remaining members of the Executive or in the case of
the Coaching Representative, by the coaching staff.

By-law 14
If an Executive is absent for more than three consecutive scheduled Executive meetings, without good
cause and/or without prior notification t o the President o r Secretary, then that office may be declared
vacant by a majority vote of the Executive.

By-law 15
The President shall act as chair of all Executive and General Meetings. In his/hers absence, the Vice-
President will fill in this duty. Make sure an Annual Audit i s completed for August 3 1 year end for
submission along with other Society Papers and Societies Act.

By-law 16
The Treasurer shall be responsible for the safe control of all club funds, for preparing and submitting to
the Executive on a regular basis a n annual budget and keeping such records a s are required for financial
review. The Treasurer is also responsible for arranging for an unaudited annual financial statement. Any
two of the President, the Vice-president and the Treasurer shall sign all cheques and legal documents.
Note: It is recommended that the Treasurer be one of the signatories.

By-law 17
The Secretary shall deal with all correspondence subject t o the approval of the President o r his/her
delegate, shall issue all notices for Executive and General Meetings, shall take minutes at all meetings. and shall be responsible for submitting t o Skate Canada and the Section such reports as are required by
Skate Canada rules and other regulations.

By-law 18
The President shall be an ex-officio member of all committees.

By-law 19
The President shall appoint standing committee Chairs whom shall look after duties assigned to them. All Committee Chairs must submit the names of their committee members to the President for
approval.

By-law 20
All Club Executive and members o f Committees shall be eligible persons and shall b e o f legal age (18
years. They must be members in good standing of the club and be Associate Members of the
Association. [Skate Canada By-law 1201 (1) (c) (ii)]

By-law 21
Rules o f order for all meetings, General and Executive, shall be as outlined i n Roberts
Rules of Order i n all cases in which they are applicable and consistent with the by-laws or special rules of
the Association [Skate Canada By-law 1603].

SKATE CANADA CLUB DELEGATE

By-law 22
The Club Delegate to Skate Canada or alternate shall be appointed annually by the Executive. The
Delegate need not be a member of the Executive. Skate Canada National Office shall be advised of the
appointed delegate's name.

ANNUAL GENERAL MEETING

By-law 23
A n Annual General Meeting shall be held within 30 days after club registration date. Other general
meetings may be held from time t o time upon the request of the Executive or upon written request of
10% of Club Members. A quorum for a n Annual General Meeting o r Special Meeting shall be 10% o f the
eligible voting members. [Skate Canada By-law 1201 (1) (c) (i) requires that each club hold an annual
meeting]

By-law 24
Written notice o f all Annual General Meetings and Special Meetings shall be provided 10 days i n
advance to each eligible voting member. The notice shall include the time and place of the meeting, the
enda, details of mendent the bylaws, a list of candidates nominated forelection and list of, notifications and up-dates will be sent out via e-mail.

By-law 25
Voting o n Club elections shall be b y secret ballot and a simple majority shall elect a candidate.
Voting on other matters may be by a show of hands.

By-law 26

Voting for club elections or on any matters pertaining t o skating shall be restricted t o eligible Club
members who are registered as Associate Members o f Skate Canada and are 18 years o f age, t o the club
Coaching representative(s) and t o Special Members o f the club voting o n behalf o f their underage
children (who are members of the club and registered as an Associate Member of Skate Canada). Special
Members shall be restricted t o one vote per family regardless of how many children are i n the family.

By-law 27
The order of business at an Annual General Meeting of the Club shall be a s follows:
• Reading of the Notice of Meeting
• Quorum
• Approval o f Agenda
• Minutes of the preceding General/Special meeting
• Confirmation of the actions taken by the Executive
• Secretary's Report
• Treasurer's Report (Annual Financial Statement)
• Other Reports
• Election of Executive
• Amendments to the Constitution and By-laws
• Appointment of Auditors (as applicable)
• New Business

AMENDMENTS

By-law 28
Any member o f the Club, in good standing, may propose an amendment t o the Constitution or bylaws of
the club. This proposal must b e submitted in writing t o the Executive. The proposed amendment will b e
presented t o the Annual General Meeting o r Special Meetings. All amendments must be submitted a t
least 2 1 days before the respective meeting. N o amendment t o the Constitution or By-laws of the Club
shall be accepted from the floor a t any meeting.

By-law 29
By-laws may be enacted or amended b y a majority vote (50% plus 1 ) o f the Executive whenever
required. Such by-laws o r amendments must be presented a t the next General Meeting for ratification
by the members. If they fail to be ratified, they will cease to be effective and may not be re-enacted by
the Executive for one calendar year.

By-law 30
Any amendment, to be accepted or ratified, must pass by a vote o f 2/3 o f those eligible to vote and
present a t an Annual General Meeting o f the Club.

By-law 31
All amendments to the by-laws upon receiving approval of any general or special meeting of members
and upon approval o f the provincial government (if applicable) shall come into force immediately o r on a
date specified for same. All such amendments shall be submitted to Skate Canada. Skate Canada
reserves the right of refusal of any amendment. Such refusal shall only be made if the intent of such
amendment is to violate, in principle or spirit, any Skate Canada rule and/or by-law.

FUNDS

By-law 32
The Treasurer by the Executive.
shall deposit all funds of the Club in such banks or other institutions as may be designated

By-law 33
All disbursements of club funds shall b e b y cheque or other auditable document.

By-law 34
A person designated by the Executive shall make a review of the financial transactions o f the Club each
year and the financial statements shall be made available t o the membership of the Club.

By-law 35
In the event that the Club ceases to exist, the net assets from liquidation shall go t o Family &
Community Support Services Fort Macleod.

CHAIR/DIRECTOR

By-law 36
Nominating Chair/Director
This Member shall be responsible for selecting at least a full slate o f candidates for election to the
Executive and shall present such a slate to the Executive no later than 21 days before an Annual Meeting
Other nominations may be made by any member in good standing by a written submission to the
Nominating Chair a t least three days before the Annual Meeting. Each nominee must indicate
acceptance in writing prior to the commencement of elections. Nominations from the floor at the
Annual Meeting will be accepted.

By-law 37
Test Chair/Director
This member shall be responsible for arranging and supervising all tests (in consultation with the
appointed referees), and obtain judges for Skate Canada tests and competitions, keeping Club records of
tests, preparing tests records for forwarding t o Skate Canada and for the encouragement o f potential
Skate Canada judges. All competition forms are to b e verified and signed b y this member as well as
Skaters/Coaches/Parents will be informed on competition dates and times.

By-law 38
Registration Chair/Director
This member shall be responsible for all club registrations within the Club and registering all skaters and
Directors with Skate Canada prior t o skaters taking to the ice.

By-law 39
Recreation Program Chair/Director
This member shall b e responsible for planning and organizing special events and activities for the Club.
